      Below are the steps that ensure you a successful registration:

    • Once registered as a customer, you can post your jobs for free.
  • How can I post a job?
      To post a job, please follow the below mentioned steps:
    • Click 'Log In' on www.callfixie.in
    • Select the 'Category' in which you are looking for a 'Fixie'
    • Enter the 'Start date of Your Job' using the calendar provided
    • Add any additional comments you may want to tell us.
    • Enter your 'Address' and 'Contact Details'
    • Upload as many photos of your job as you can. This will also help attract accurate quotes from relevant fixies.
    • 'Submit' your job.
  • What if more than one fixie is required at a time?
      Many of our fixies are adept at multi-trades. It is possible to select multiple categories, if you are unsure about the fixie category to select. You may also select 'Other' as a category, if you cannot find the relevant category for your job.
  • How can I edit a job I’ve posted?
      You can call our CS Team and they will assist you as soon as possible.
  • How can I choose and accept a quote?
    • Click 'Log In' on www.callfixie.in
    • Enter your 'Username' and 'Password'
    • Go to 'My Jobs' and click on 'Posted Jobs' tab
    • Quotes will be available on your posted job
    • Click on 'Accept'
    • The fixie will be notified that you have accepted their quote.Your details will be shared with the fixie. The Customer Service Team will then contact you to arrange a preferred time to complete the job.
  • How will I be required to pay for the job?
      You will be asked to pay by Cash/ Bank Transfer/ PayPal after the job is completed.
  • Whom are my details shared with?
      As a customer, your details will only be shared, once you have accepted a quote from a fixie.
  • What should I do if the fixie doesn’t turn up?
      All our fixies commit to a code of conduct. However, unavoidable circumstances may arise. In this case, we expect our registered fixies to inform you in advance. If they do not, you can contact them directly or contact us to remind them to follow-up with you.Our number is 8000 600 111.
  • How to rate and review a fixie?
      To rate and review a fixie:
    • Click on 'Job Completed'
    • You will be asked to review the customer, and they will review you.
  • What if I need site inspection done before the job?
      If in the event, a site inspection is necessary to complete the job, we will arrange a site inspection for customers. This will also help the fixie to attract accurate quotes. If both parties can't reach an agreement after the inspection, either of them can call us on 8000 600 111.
  • What is the dispute resolution process with Callfixie?
      Callfixie will arbitrate all disputes between customers and fixies. If a dispute fails to be resolved, it will be sent to Consumer Council.

  • When can I call a customer?
      As soon as the customer approves of your quote, we will contact customer promptly. If the quote is approved during non-business hours, you can simply drop a text message and we will contact you shortly. Or, you can follow up on the next business day.
  • Where can I see the customer’s contact details?
      Once the customer accepts your quote, you will receive notifications in your app. We will contact you regarding their contact details.
  • Can I add other jobs to my profile?
      Yes, you can. Provided you have the relevant license for all the skills that you have advertised. You are free to add as many skills and regions as you want. Simply keep all secondary skills separate, making sure that they do not overlap.
  • Why do I need to give my license and insurance details?
      We have promised our customers services from verified Fixies. Therefore, we will need to ensure that your business is registered, licensed, insured and qualified. This is also crucial for you as a Fixie to establish trust with our customers. Updating your license and insurance timely is also important.
  • Why do I need a business insurance?
      Appropriate insurance and license are important for us to qualify you and for our customers to place their faith in you. This is a non-negotiable necessity, for our customers thrive on credibility.
  • How can I register as a fixie?
      To register as a fixie, please follow the below listed steps:

    • Go to 'Our Fixies Page' and click on 'Become a fixie'

  • PRIVACY POLICY

    Tradesman Services (India) Pvt. Ltd., operating under the brand name of “CallFixie” (“CallFixie”) adheres to the Information Technology Act, 2000 (the "Act"). This privacy policy governs the manner in which CallFixie collects, uses, maintains and discloses information collected from any person who visits the www.callfixie.in website or the mobile application that is developed and owned by CallFixie ("Site").Any such person who shall visit the Site shall be referred to as "User ". There is requirement of compliance with Act which are not specifically described in Our privacy policy but are deemed to be incorporated in this privacy policy and We will adhere to that.
    This privacy policy applies to the Site and all products and services offered by Callfixie. The reference to terms "You" or “Your” shall mean User and the terms "We", "Us" or "Our" shall mean Callfixie including any contractors or call center or any authorized third party to which we refer collectively in this document as Callfixie.

  • DISPUTE RESOLUTION POLICY

    Purpose


    CallFixie is independent of any relationship formed between the Tradesman and the User by using CallFixie’s website, www.callfixie.in (“Site”). Generally, transactions are conducted smoothly on Site. However, there may be some cases where both the Tradesman and User may face issues and in such cases, CallFixie, wherever possible, will attempt to facilitate a quality relationship between all parties. At CallFixie, we have a Dispute Resolution Process in order to resolve disputes between Tradesman and User.
    The purpose of this policy is to provide clarity on the process CallFixie will use when notified of a dispute between a User and a Tradesman. Our sole objective is to resolve and assist in to resolve any dispute and encourage and facilitate a smooth and hassle free transaction between the Tradesman and Users of CallFixie

    If CallFixie is notified of a dispute between the User and the Tradesman, the following procedure will be applicable:

    Identification and Determination of Dispute

    1. A 'Dispute' can be defined as a disagreement between a User and a Tradesman in connection with a transaction on the Site.
    2. Upon receiving a notification either from the Tradesman or User, CallFixie will promptly evaluate the level of severity of a dispute and categorize the dispute as either: (i) Major dispute; or (ii) Minor dispute.
    3. Where a dispute is deemed as Major dispute, the registration of the concerned Tradesman with Site shall get immediately suspended and shall remain suspended till the outcome of the procedural evaluation of the dispute
    4. Where a dispute is deemed as Minor Dispute, the registration of the concerned Tradesman with Site shall not get suspended till the outcome of the pending procedural evaluation of the dispute.

    CallFixie shall attempt to evaluate and resolve the dispute before deciding the status of registration of Tradesman account with the Site.

    Evaluation Mechanism

    1. User statement record: CallFixie shall contact the User and will document User’s statement and all issues and grievances User has against the Tradesman
    2. Tradesman statement record: CallFixie shall contact the Tradesman and notify about the dispute and shall document Tradesman statement pertaining to the issue raised in the dispute.

    Resolution of a Minor Dispute


    In order to resolve a Minor Dispute, CallFixie shall:
    1. Contact the User for obtaining detailed information and update the User about the procedure mechanism, including the role that CallFixie acts mere as a dispute resolution facilitator and not a party to the dispute in any circumstances.
    2. Contact the concerned Tradesman and notify about the dispute and shall document Tradesman statement pertaining to the issue raised in the dispute.
    3. Discuss with the Tradesman internal dispute resolution process and offer possible options for resolution.
    4. Register "record of dispute" on Tradesman's account.
    5. Contact User within 48 hours working hours to determine the status of dispute

    CallFixie shall follow following mechanism to update the status of a dispute:
    1. If dispute resolved - process closed;
    2. If dispute resolution is under process - maintain contact with customer and update about the status of dispute;
    3. If dispute has been escalated, activate the Major Dispute process.

    Resolution of a Major Dispute


    In order to resolve a Major Dispute, CallFixie shall:
    1. Contact the User for obtaining detailed information and to inform and update about the procedure and mechanism, including the role that CallFixie acts mere as a dispute resolution facilitator and not a party to the dispute in any circumstances.
    2. Contact the concerned Tradesman and notify about the dispute and shall document Tradesman statement pertaining to the issue raised in the dispute and discuss options for non-adversarial resolution.
    3. Offer to facilitate non-adversarial resolution and assist parties to resolve the dispute.

    4. Assist User, if dispute remains unresolved, to:
      1. Pursue remedy through normal options such as, government authority, regulatory body or industry ombudsman, normal litigation channel, VCAT, Victorian Builders Association etc. and
      2. Inform Tradesman that registration will remain suspended depending on the final resolution.

    Provided that, if resolution of the dispute results in imposition of any charges pertaining to criminal or illegal activity, re-registration of such Tradesman shall not to be considered. However, if resolution of the dispute results in imposition of punitive action in the form of damages or penalty, re-registration the Tradesman may be considered to be reactivated subject to that the Tradesman satisfies the management of CallFixie that the dispute is resolved in properly and appropriately manner.

    Record of Dispute

    1. A record of dispute shall be maintained whenever a dispute is registered against a Tradesman.
    2. Should a Tradesman have two (2) or more Minor Disputes recorded per year against a Tradesman, a notice of warning will be issued.
    3. Issuance of the 3rd notice of warning within any period of twelve (12) months period, at the sole discretion of CallFixie, may result in suspension of the Tradesman’s registration with the Site.
    4. Re-registration will not be activated until the Tradesman satisfies the management of CallFixie that remedial actions have been enacted and undertaken by the Tradesman to eliminate disputes.
    5. Should registration be reactivated, a further warning within a period of six (6) months may result in cancellation of the Tradesman registration.

    Guidelines for Determining Dispute Status


    1. Minor Dispute
      1. Dispute regarding timekeeping or punctuality
      2. Dispute regarding price variations of less than ten percent (10%)
      3. Dispute regarding cleanliness, housekeeping or language
      4. User generally unhappy with quality of work and workmanship
      5. Minor damage to User’s property

    2. Major Dispute
      1. Violence or abuse
      2. Breach of code of conduct
      3. Failing to complete work
      4. Price variations greater than ten percent (10%)
      5. User is highly unsatisfied about quality of work and workmanship
      6. Significant damage to User’s property
      7. Any allegations of theft or gross misconduct

    General


    A suspended registration cannot be re-activated until the cause of the suspension is resolved. CallFixie will be entitled to recover reasonable costs incurred in determining the status of dispute and any other work in order to assisting the resolution as well as administrative expenses incurred as a result of the dispute.
    CallFixie retains the absolute right and discretion, without dispute, to determine who will be registered with CallFixie.

    Responsibilities

    The Director of Operations is responsible for the maintenance of this policy. New releases will be made available as changes to the processes are made. All changes must be reviewed and approved by the Jaarwis legal counsel.

  • COLLECTION OF PERSONAL INFORMATION

    ‘Information’ in our privacy policy has the same meaning as in the Privacy Act, namely it means information about an identified individual or an individual who is reasonably identifiable.
    CallFixie will collect personal information only by lawful and fair means. We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, register on the site, place an order, respond to a survey, fill out a form, and in connection with other activities, services, features or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identification information, except that it may prevent them from engaging in certain Site related activities.
    We may also collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users means of connection to our Site, such as the operating system and the information of internet service providers utilized and other similar information.

    The domain name www.callfixie.in, available on web portal and CallFixie App (as defined under the definition clause herein below), a mobile web application, (hereinafter CallFixie web portal and/or CallFixie App individually or jointly referred to as "Site") is owned by Tradesman Services (India) Private Limited, a company incorporated as per the Companies Act, 2013 having its registered office at Floor 3rd, Universal Business Park, Sector 66, Golf Course Extension Road, Gurgaon – 122001 (hereinafter referred to as "CallFixie").
    Any User who browses or uses the Site shall be governed by the following terms and conditions ("Terms of Use") as applicable to the Site including the applicable policies which are incorporated herein by way of reference. If You transact on the Site, You shall be subject to the policies that are applicable to the Site for such transaction.By mere use of the Site, You shall be contracting with CallFixie and these terms and conditions including the policies constitute Your binding obligations, with CallFixie.       • Service Referralmeans notification to the Tradesman by CallFixie pertaining to posting of a Service or Service(s) by the User on the Site.
      • Privacy Policy means CallFixie’s privacy policy which is available on the Site.
      • Tradesman / Service Provider means any legal person who accesses or uses the Site and who register itself on the Site and agrees to provide services to User of Site.
      • Tradesman Servicesmeans providing of services by a Tradesman to a User in order to complete a Service.
    • For the purpose of these Terms of Use, wherever the context so requires "You" or “Your” shall mean User. The term "We", "Us", "Our" shall mean CallFixie.
    • The paragraph headings in the Terms of Use, incorporated in bold and capitalised case, are included to help make provisions of Terms of Use easier to read and have no binding effect.
    • Any reference to a clause hereunder is a reference to a clause of Terms of Use: User.

    Legally Binding Agreement
    By accessing or using the Site, you acknowledge that you have read, accepted and agreed to be legally bound by these Terms of Use and any notices, protocols or guidelines appearing on or in connection with the Site, as amended from time to time.     Services, Cookies and CallFixie’s Role
    • Services: CallFixie is an online web and mobile application which connects User, who require the Tradesman Services. CallFixie facilitates a User to register itself on the Site and connects it with the Tradesman to avail Tradesman Services for a Service when the User posts its service requirement on the Site.
    • Cookies: This Site uses cookies. By using this Site and agreeing to these terms and conditions, You consent to CallFixie's use of cookies in accordance with the terms of CallFixie's cookies policy, prescribed under Privacy Policy.
    • CallFixie’s role: User acknowledges and agrees that CallFixie’s role is as a neutral facilitator only and it is not a party or directly involved in the transactions between User(s) and Tradesman and will not be involved in or a party to any agreement, contract or arrangement between the User and any Tradesman regarding any Service.

    Registration
    • The User shall be required to provide necessary data, information and proof of documents to register itself on the Site (“Registration”). Upon successful Registration to the satisfaction of CallFixie, the User will be issued by CallFixie an identification number and password to use and access the Site. The User agrees that CallFixie shall be entitled to assume that any person using the Site with the User's identification number (“User Account”) and/or password is the User or its authorised representative.

    • In order to Register and open an "User Account" with CallFixie, You must
      • agree to these Terms of Use,
      • provide a valid email address, and
      • provide any other information required by CallFixie during the Registration process.

    • You must update this information to maintain its accuracy during the term of Your Registration for accessing the Site. You are responsible for maintaining the security and confidentiality of Your User Account and password. CallFixie cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are also responsible for all content that you may post on the Site ("Content") and activity that occurs under your User Account (even when Content is posted by others by accessing your account or who have accounts under your Account). Any and all personally identifiable information submitted by you shall be subject to CallFixie's Privacy Policy, updated from time to time on the Site
    • One User shall not maintain more than one User Account without the prior written consent of CallFixie. User Account registered by "bots" or other automated methods are not permitted.
    • The entire process of Registration including creation of User Account and generation of password may take up to fourteen (14) working days to be processed and approved.

    Service Posting Notification
    • If the User posts a Service that appears on the Site, CallFixie may, in its discretion choose to notify or not notify the Service posting by User to any Tradesman.
    • Without prejudice to the fact that whether or not a particular Tradesman has been notified pertaining to a particular Service posting by CallFixie, the User is not permitted to individually pursue any Service directly with any Tradesman of its choice. If any Tradesman is contacted directly by an User in relation to a new Service, CallFixie will have all right to refuse to make available Tradesmen Services to User and debar User from doing any transaction in the future by using the Site.
    • If any Tradesman's contact details provided to the User by CallFixie are incomplete or inaccurate and does not enable the User to contact the Tradesman, the User must notify the same to CallFixie within twenty-four (24) hours of discovering this. Upon receipt of such notification, CallFixie will use its reasonable endeavor to confirm the accuracy of the relevant Tradesman's contact details and provide revised contact details to User.

    Relationship with Tradesman and User
    • The User acknowledges and agrees that details of performing the Service and the terms and conditions including warranties, indemnities and guarantees of any agreement relating to the Service are to be determined solely between the User and the Tradesman and CallFixie performs no role in this process and accepts no liability in this respect.
    • The User acknowledges and agrees that CallFixie: (i) is a neutral facilitator and is not in any manner directly involved in any dealing in relation to a particular Service which User may decide to enter into with a Tradesman; and (ii) shall not be liable in any manner for any direct or indirect loss or damage incurred as the result of any such dealing.

    Fees, Charges and Payment

    • The User agrees that Tradesman shall charge the Fee to User for providing agreed Tradesman Services and the User shall be liable to pay:
      • Fee or any amount that is agreed between User and Tradesman with regards to the Tradesman Services availed by the User by posting Service on the Site;
      • Any other fees applicable to any new services that the User avails through the Tradesman.
      • The Fee and all other charges are exclusive of all federal, state, or other governmental sales, good and services, as well as charges or fees enacted in the future. The User shall be liable to pay Goods and Services Tax (“GST”) and any other applicable tax or statutory levies on the amount of Fee at the prevailing statutory rate.

    • For any and all User Accounts, CallFixie may charge an account re-activation fee should an account need to be re-activated after the Use Account has become de-activated due to non-payment or for other breaches of the Terms of Use.

    System Records
    The User agrees that CallFixie's records (including records of SMS messages sent by or on its behalf) shall be conclusive evidence of CallFixie's transmission and User’s receipt of notifications.
    No Warranties
    You acknowledge and agree that your use of this Site is as 'made available' basis only and may only be available during planned and unplanned outages. CallFixie makes no representation and gives no warranty that the alternate login services provided via the Site will meet your requirements, be uninterrupted, timely or error-free.
    User Warranties
    The User warrants to and agrees with CallFixie that:
    • It or any authorised person of User is at least eighteen (18) years of age or above. By using this Site and by agreeing to Terms of Use, it represent and warrant that it is under no legal or other impediment that may prevent it fully carrying out and performing its obligations under these Terms of Use;
    • All information (including but not limited to that set out in the application for Registration (registration form) including information relating to User’s is true and correct in every respect and will be updated by the User if and when it materially changes till the period User’s Registration is active with the Site;
    • All information provided by the User to CallFixie will not infringe intellectual property rights of any third party and will not be false, inaccurate or misleading, abusive, vulgar, hateful, harassing, obscene, threatening, defamatory or violate any applicable law or regulation;
    • It will not impersonate or misrepresent any endorsement by or affiliation with any person or entity;
    • It will at all-time comply with CallFixie 's Privacy Policy, as prescribed on and updated from time to time on the Site;
    • It will not engage in misleading or deceptive marketing practices over the Site;
    • It will not release to the public any news release, advertising material, promotional material or any other form of publicity or information on the Site without CallFixie 's prior written approval;

    License to use Site / CallFixie App
    • CallFixie and/or its licensors own any and all intellectual property rights in the Site including any and all materials, information and contents on the Site. Subject to the license below, all these intellectual property rights are reserved and exclusive property of CallFixie and/or its licensor.
    • Subject to your compliance with these Terms of Use, we grant you a limited non-exclusive, non-transferable license to download and install one copy of the CallFixie App on your mobile device and to run such copy of the CallFixie App solely for your own personal use.
    • You may view and download required information or contents from the Site as required for the purposes of performing your obligation under these Terms of Use and You may print pages or other content from the Site in order to performing Your obligation under these Terms of Use, subject to the restrictions set out below in sub-clause 3 and elsewhere in these Terms of Use.

    • You must not:
      • republish material from this Site (including republication on another website);
      • sell, rent or sub-license material from the Site;
      • show any material from the Site in public;
      • reproduce, duplicate, copy or otherwise exploit material on this Site for a commercial purpose;
      • edit or otherwise modify any material on the Site; or

    User Content
    • In reference to these Terms of Use, “User Content” means material (including without limitation text, images, audio material, video material and audio-visual material) that You submit to this Site, for whatsoever purpose.
    • You grant to CallFixie a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate and distribute User Content in any existing or future media. You also grant to CallFixie the right to sub-license these rights, and the right to bring an action for infringement of these rights.
    • The User Content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or CallFixie or a third party (in each case under any applicable law).
    • You must not submit any of the User Content to the Site that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint or action.
    • CallFixie reserves the right to edit or remove any material submitted to this Site, or stored on CallFixie’s servers, or hosted or published upon this Site.
    • Notwithstanding CallFixie’s rights under these terms and conditions in relation to the User Content, CallFixie does not undertake to monitor the submission of such content to, or the publication of such content on, this Site.

    Limitations of Liability

    • Notwithstanding anything to the contrary under Terms of Use, CallFixie will not be liable to You (whether under the law of contact, the law of torts or otherwise including, without limitation, negligence, breach of any Statute or any other legal or equitable obligation) for any claim connected with or arising out of use of the Site, provision of the Services and/or Tradesman Services and any transaction contemplated under the ambit of Terms of Use in connection with, the Site:
      • to the extent that the Site is provided free-of-charge, for any direct loss;
      • any indirect, special or consequential loss; or
      • any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
    • These limitations of liability shall apply even if CallFixie has been expressly advised of the potential loss.
    • Subject to Clause 1 and 2 hereinabove, under any circumstances, CallFixie’s aggregate liability, irrespective of the nature of the claim, shall not exceed the amount paid by the User to a Tradesman for performance of Tradesman Services regarding a particular Service.

    • Reasonableness
      • By using this Site, you agree that the exclusions and limitations of liability set out in this Site disclaimer are reasonable.
      • If you do not think they are reasonable, you must not use this Site.
      • You accept that, as a limited liability entity, CallFixie has an interest in limiting the personal liability of its officers and employees. You agree that You will not bring any claim personally against CallFixie’s officers or employees in respect of any losses you suffer arising in connection with the usage of this Site.

    Unenforceable Provisions
    If any provision of this Site disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this Site disclaimer.
    Indemnity
    You hereby agree to indemnify and hold harmless CallFixie and its subsidiaries, affiliates, officers, directors, shareholders, employees and agents and undertake to keep CallFixie and its subsidiaries, affiliates, officers, directors, shareholders, employees and agents indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by CallFixie to a third party in settlement of a claim or dispute on the advice of CallFixie’s legal advisers) incurred or suffered by CallFixie arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.
    Breach of Terms of Use
    Without prejudice to User having other rights under these Terms of Use, if You breach any Terms of Use in any way, CallFixie may take such action as CallFixie deems appropriate to deal with the breach, including suspending your access to the Site, prohibiting you from accessing the Site, blocking computers using Your IP address from accessing the Site, contacting Your internet service provider to request that they block Your access to the Site and/or bringing court proceedings against You.
    Variation
    CallFixie may revise these Terms of Use from time-to-time. Revised terms and conditions will be effective and applicable to the use of this Site from the date of the publication of the revised terms and conditions on this Site. Please check this page of the Site regularly to ensure you are familiar with the current version.
    Assignment
    CallFixie may transfer, assign, license, sub-contract or otherwise deal with CallFixie’s rights and/or obligations under the Terms of Use without notifying You or obtaining Your consent.
    You will not transfer, assign, license, sub-contract or otherwise deal with Your rights and/or obligations under the Terms of Use.
    Severability
    If a provision of the Terms of Use is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if a part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.
    Entire Agreement
    The Terms of Use constitute the entire agreement between You and CallFixie in relation to your use of this Site, and supersede all previous agreements in respect of Your use of this Site.
    Law and Jurisdiction
    The Terms of Use will be governed by and construed in accordance with the laws governing Commonwealth of Australia, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Commonwealth of Australia
    Dispute Resolution
    User agrees and acknowledges that in the event of any dispute between a User and Tradesman, User shall abide by the CallFixie’s Dispute Resolution Policy, provided on the Site and update from time to time.

    The domain name www.callfixie.in, available on web portal and CallFixie App (as defined under the definition clause herein below), a mobile web application, (hereinafter CallFixie web portal and/or CallFixie App individually or jointly referred to as "Site") is owned by Tradesman Services (India) Private Limited, a company incorporated as per the Companies Act, 2013, having its registered office at Floor 3rd, Universal Business Park, Sector 66, Golf Course Extension Road, Gurgaon – 122001 (hereinafter referred to as "CallFixie").
    Any legal person who registers itself on the Site and agrees to provide services to User (as defined below under Definition and Interpretation Clause) through the Site(“Service Provider”) shall be governed by the following terms and conditions ("Terms of Use") as applicable to the Site including the applicable policies which are incorporated herein by way of reference. If You transact on the Site, You shall be subject to the policies that are applicable to the Site for such transactions. By mere use of the Site, You shall be contracting with CallFixie and these terms and conditions including the policies shall constitute Your legally binding obligations, with CallFixie. If You disagree with these Terms of Use, You must not use this Site.
    (CallFixie reserves the right to update and/or modify the Terms of Use; therefore, Service Provider is encouraged to check for changes made to the Terms of Use that may affect them. If CallFixie changes the terms, it shall be updated on the Site and shall be considered effective with immediate effect. Additionally, CallFixie reserves the right to refuse Services under the terms of Use. Service Provider is deemed to agree with and comply with the terms and conditions set forth below by CallFixie.)

    TERMS OF USE


    Definitions and Interpretation

    1. In the Terms of Use, unless the context otherwise requires:
      • Agreementmeans these Terms of Use including any reference of other terms and conditions and/or policy therein.
      • Code of Conductmeans CallFixie’s code of conduct which is available on the Site.
      • Due Date means the date of acceptance by the User to avail the services of a Service Provider in order to perform a Service.
      • Feemeans the amount that is mutually agreed between User and Tradesman with regards to the Tradesman Services availed by the User by posting Service on the Site.
      • Tradesman Servicesmeans providing of services by a Tradesman to a User in order to complete a Job.
      • Servicemeans the job requirements of a User which are posted on the Site.
      • Service Referral means notification to the Service Provider, using Service Provider’s contact details, by the CallFixie in relation to posting of a Service or Service (s) by the User on the Site.
      • Privacy Policy means CallFixie’s privacy policy which is available on the Site.
      • Usermeans any person who accesses or uses the Site and agrees to avail the services provided by the Service Provider by posting job requirements on the Site.
    2. For the purpose of these Terms of Use, wherever the context so requires "You" or “Your” shall mean Service Provider or any authorized person of Service Provider. The term "We", "Us", "Our" shall mean CallFixie
    3. The paragraph headings in the Terms of Use, incorporated in bold and capitalize case, are included to help make provisions of Terms of Use easier to read and have no binding effect.
    4. Any reference to a clause hereunder is a reference to a clause of Terms of Use

    Services, Cookies and CallFixie’s Role
    1. Services:CallFixie is an online web and mobile application which connects customers, who require the services of a Service Provider. CallFixie facilitates a Service Provider to register itself through Registration on the Site and connects it with the User to undertake a Service when a User posts its requirement on the Site.
    2. Cookies:This Site uses cookies. By using this Site and agreeing to these terms and conditions, You consent to CallFixie's use of cookies in accordance with the terms of CallFixie's cookies policy, prescribed under Privacy Policy.
    3. CallFixie’s role: Service Provider acknowledges and agrees that CallFixie’s role is as a neutral facilitator only and it is not a party or directly involved in the transactions between User(s) and Service Provider and will not be involved in or a party to any agreement, contract or arrangement between the Service Provider and any User regarding any Service .

    Registration
    1. The Service Provider shall be required to provide necessary data, information and proof of documents to register itself on the Site (“Registration”). Upon successful Registration to the satisfaction of CallFixie, the Service Provider will be issued by CallFixie a user identification number and password to use and access the Site. The Service Provider agrees that CallFixie shall be entitled to assume that any person using the Site with the Service Provider's user identification number (“User Account”) and/or password is the Service Provider or its authorized representative.

    2. In order to register and open a User Account with CallFixie, You must:
      1. agree to these Terms of Use,
      2. provide a valid email address,
      3. agree to exclusively download and use CallFixie App on Your mobile device to access and perform any Service as posted on the Site ; and
      4. provide any other information required by CallFixie during the Registration process.

    3. You must update this information to maintain its accuracy during the term of Your Registration for availing the Services on the Site. You are responsible for maintaining the security and confidentiality of Your User Account and password. CallFixie cannot and will not be liable for any loss or damage from Your failure to comply with this security obligation. You are also responsible for all content that You may post on the Site ("Content") and activity that occurs under Your User Account (even when Content is posted by others by accessing Your account or who have accounts under Your Account). Any and all personally identifiable information submitted by You shall be subject to CallFixie's Privacy Policy, updated from time to time on the Site.
    4. One Service Provider shall not maintain more than one User Account without the prior written consent of CallFixie. User Account registered by "bots" or other automated methods are not permitted.
    5. The Service Provider specifically agrees and acknowledges that the entire process of registration including creation of User Account and generation of password may take up to fourteen (14) working days to be processed and approved.

    Service Referral
    1. If a Service Provider receives a Service Referral or views a Service that appears on the Site, it may, in its discretion choose to pursue or not pursue the Service Referral. To pursue a Service Referral, the Service Provider must accept the Service Referral using the mechanism provided on the Site.
    2. Without prejudice to the fact that whether or not the Service Provider has been notified pertaining to a particular Service Referral by CallFixie, the Service Provider is not capable of accepting a Service Referral that has already been accepted by the other Service Provider from whom User has already requested quotes or estimates at the time of purported acceptance by the Service Provider,. CallFixie does not take any responsibility for already accepted Service Referrals by other Service Providers. However, if CallFixie is contacted by the Service Provider in relation to an already accepted Service Referral, CallFixie will use reasonable endeavor to notify the Service Provider, that the Service Referral is no longer capable of acceptance by the Service Provider, as soon as possible.
    3. If any User's contact details given to the Service Provider by CallFixie are incomplete or inaccurate and does not enable the Service Provider to contact the User, the Service Provider must notify the same to CallFixie within twenty-four (24) hours of discovering this. Upon receipt of such notification, CallFixie will use its reasonable endeavor to confirm the accuracy of the relevant User's contact details and provide revised contact details to Service Provider.

    Relationship with Service Provider and User
    1. The Service Provider acknowledges and agrees that details of performing the Service and the terms and conditions including warranties, indemnities and guarantees of any agreement relating to the Service are to be determined solely between the Service Provider and the User and CallFixie shall perform no role in this process and accepts no liability in this respect.
    2. The Service Provider acknowledges and agree that CallFixie: (i) is a neutral facilitator and is not in any manner directly involved in any dealing in relation to a particular Service which Service Provider may decide to enter into with a User; (ii) does not confirm the identity of any User, their backgrounds or credit-worthiness or their ability, competence or willingness to avail the services related to Service from You and (iii) shall not be liable in any manner for any direct or indirect loss or damage incurred as the result of any such dealing.

    Fees, Charges and Payment

    1. The Service Provider agrees that CallFixie shall charge the Fee to Service Provider and the Service Provider shall be liable to pay:
      1. Fee or any amount that is agreed between CallFixie and Service Provider with regards to the Service availed by the Service Provider through CallFixie’s Site;
      2. Any other fees applicable to any new Services that CallFixie offers or may offer and that the Service Provider accepts during the Service Provider's registration.
      3. The Fee and all other charges are exclusive of all sales, good and services tax, as well as charges or fees enacted in the future. The Service Provider shall be liable to pay Goods and Services Tax (“GST”) and any other applicable tax or statutory levies on the amount of Fee at the prevailing statutory rate.

    2. A valid credit card shall be required to be possessed by the Service Provider to enable CallFixie to deduct the Fee and any other charges, if applicable, by using Service Provider’s credit card. Payment of the Fee by the Service Provider to CallFixie may be made by credit card or direct credit (EFT). If the Service Provider pays by credit card, the Service Provider agrees and acknowledges to authorize CallFixie to automatically charge any Fees (including renewal fees, if applicable) to such card.
    3. The Service Provider acknowledges and agrees that the Fee and any other payment due under this Terms of Use shall not be deemed to have been received until all amounts payable are received as clear funds in CallFixie's bank account.
    4. The Service Provider shall be required to make payment within the Due Date. Time of payment is essence of the Terms of Use and if the Service Provider fails to make payment within the Due Date, CallFixie shall be entitled to charge an interest of five percent (5%) per day calculated on the due amount from the Due Date till the amount paid in full to CallFixie. Without prejudice to the above and any other rights and remedies available under the applicable laws, CallFixie may, at its sole discretion, terminate or suspend Registration and access to the System without notice if any payment due from The Service Provider remains unpaid after a period of seven (7) days from the Due Date.
    5. CallFixie reserves the right to increase Fee or to institute new fees or charges, upon reasonable notice provided to the Service Provider and/or posted on the Site.
    6. You agree and acknowledge that all payments are non-refundable. There will be no refunds or credits of the Fee received by CallFixie from the Service Provider in lieu of the Services including, Service Referral provided by CallFixie to the Service Provider. In order to treat everyone equally, no exceptions will be made.
    7. For any and all User Accounts, CallFixie may charge an account re-activation fee should an account need to be re-activated after an account has become de-activated due to non-payment or for other breaches of the Terms of Use.

    System Records
    1. The Service Provider agrees that CallFixie's records (including records of SMS messages sent by or on its behalf) shall be conclusive evidence of CallFixie's transmission and Service Provider’s receipt of notifications.
    2. The Service Provider agrees that CallFixie’s records of information provided by User for the purpose of tracking and verifying total Services value for Services can be deemed by CallFixie to be conclusive evidence of the total Services value, referred by CallFixie and performed by the Service Provider, and will be applied for the purpose of calculation of the Fee.

    No Warranties
    You acknowledge and agree that Your use of this Site is as 'made available' basis only and may only be available during planned and unplanned outages. CallFixie makes no representation and gives no warranty that the alternate login services provided via the Site will meet Your requirements, be uninterrupted, timely or error-free.
    Service Provider Warranties
    The Service Provider warrants to and agrees with Callfixie that:
    1. It or any authorized person of Service Provider is at least eighteen (18) years of age or above. By using this Site and by agreeing to Terms of Use, it represents and warrant that it is under no legal or other impediment that may prevent it fully carrying out and performing its obligations under these Terms of Use;
    2. It and any personnel it engages are and will at all times remain qualified to offer and perform the Services as posted on the Site;
    3. It shall exclusively download and use CallFixie App on its mobile device to access and perform Service and undertakes that it shall not download or use any other mobile application which is similar in any manner or a competitor to CallFixie App; and
    4. It and all personnel engaged by it will comply with the Code of Conduct, as prescribed and updated from time to time by CallFixie, and exercise a high degree of skill, care and professionalism in providing the Services to the Users;
    5. It has all insurance required for performing a Service as required in accordance with the Service Provider's professional skill, expertise and area of practice;
    6. All information (including but not limited to that set out in the application for Registration (registration form) including information relating to Service Provider’s qualifications and capacity (including those of its employees) is true and correct in every respect and will be updated by the Service Provider if and when it materially changes till the period Service Provider’s Registration is active with the Site;
    7. All information provided by the Service Provider to CallFixie or the User will not infringe intellectual property rights of any third party and will not be false, inaccurate or misleading, abusive, vulgar, hateful, harassing, obscene, threatening, defamatory or violate any applicable law or regulation;
    8. It will not impersonate or misrepresent any sponsorship, endorsement by or affiliation with any person or entity;
    9. It will at all-time comply with CallFixie's Privacy Policy, as prescribed on and updated from time to time on the Site;
    10. It will not engage in misleading or deceptive marketing practices;
    11. At the time of accepting a Service Referral, it will be able and willing to perform the Service , within a commercially reasonable time and at a commercially acceptable price;
    12. It must not cancel or reschedule any appointment made with a User (whether to provide a quotation, perform the Service or otherwise) without prior notification to and acceptance by the User; and

    1. CallFixie and/or its licensors own any and all intellectual property rights in the Site including any and all materials, information and contents on the Site. Subject to the license below, all these intellectual property rights are reserved and exclusive property of CallFixie and/or its licensor.
    2. Subject to Your compliance with these Terms of Use, we grant You a limited non-exclusive, non-transferable license to download and install one copy of the CallFixie App on Your mobile device and to run such copy of the CallFixie App solely for Your own personal use.
